Violations of Article 6 (1)
Alleged violation of Article 6, par. 1
“In the determination of his civil rights and obligations or of any criminal charge against him, everyone is entitled to a fair and public hearing within a reasonable time by an independent and impartial tribunal established by law. Judgment shall be pronounced publicly but the press and public may be excluded from all or part of the trial in the interests of morals, public order or national security in a democratic society, where the interests of juveniles or the protection of the private life of the parties so require, or to the extent strictly necessary in the opinion of the court in special circumstances where publicity would prejudice the interests of justice.”
Unfortunately, nobody in this case tried to reveal that biases except the Public Defender of Georgia, whose report of 2006 objectively and impartially demonstrates the facts and evidence proving the applicants' innocence. The Public Defender's report emphasized the following:
“The judgment delivered by the courts is not supported by evidence collected in the case”, "the inaccuracies and errors are not infrequent in the judgment and their aim is to prove N. Lobzhanidze's and Z. Oboladze's culpability on the basis of non-existent evidence” (see the attached Annex A.. ---).
Nevertheless, this report had no effect, because terror and purges hidden behind a mask of current reforms in Georgia, serve to spread fear and obedience and not to achieve justice or provide real institutional innovation. The spread of fear and obedience is brought about in different ways, but because this specific case concerns physicians, and in order to illustrate the foregoing contention, the applicants give a quotation from a TV interview of ( the now former) Minister of Labor, Healthcare, and Social Welfare of Georgia, Lado Chipashvili:
“We try to reveal in every specific case the criminals responsible for different episodes, including our colleagues - physicians. Probably, this is the reason that we have such a large number of punished physicians. I would like to tell you that since the communist period altogether in fifteen years not so many physicians were punished as there were in the last one year". (See the attached Annex A.. - the DVD).
On the other hand such introduction of prejudicial statements by high-ranking public officials constitutes a violation of presumption of innocence.
