Violations of Article 6 (3)
Alleged violation of Article 6, par. 3 lit. "b", "c" and "d" of the Convention Article 6, par. 3:
Everyone charged with a criminal offence has the following minimum rights: - lit. (b)
to have adequate time and the facilities for the preparation of his defence
- lit. (c)
to defend himself in person or through legal assistance of his own choosing or, if he has not sufficient means to pay for legal assistance, to be given it free when the interests of justice so require - lit. (d)
to examine or have examined witnesses against him and to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him The applicants allege the violation of paragraph 3, lit “b”, “c” and “d” of Article 6 of the Convention with respect to them from the very moment of their detention. Specifically, the applicants' defense counsels were not permitted to familiarize themselves with the case materials pertaining to the application of a preventive measure to the applicants because these materials were sent to the Mtskheta Regional Court for examination only fifteen minutes after the applicants' interrogation was over. Then the court, for its part, started the hearing only half an hour later. The hearing ended at 2:00 a.m. (See the attached Annex A.. - DVD). __________
